TRAFFIC CITATIONS
In Georgia all traffic citations are misdemeanors which carries a $1000 and/or a maximum of 12 months in jail. This means that you are entitled to the full due process of the law. This means that drivers are entitled to a jury trial in almost all misdemeanors. Requesting a jury trial will get your case handled in a more effecient manner. As a result most prosecutors are will to compromise on cases to help get them settled. As a prosecutor I handled all types of traffic citations including, speeding, hit and run, no proof of insurance, no license on person, Driving on a Suspended License, Driving While License Suspended, Improper Turn, Accidents case where the at-fault driver was issued a citations and many others.
Georgia also has a complex points system. Points are assessed for various citations and most are about 3 points each. Your driver license can be suspended for accumulation 15 points within a 24 month period. Under 21 drivers and CDL are especially at risk. A driver under 21 years of age will lose the privilege to drive in Georgia for being 24 or more miles over the posted speed limit. CDL can loose their license for any serious violations, and speeding in your personal car is considered one of those "serious violations."
All traffic citations are arrest able offense. A person signs for receiving the traffic citation in lieu of going to jail. However, the officer has discretion. Please be nice and sign your ticket. However, never pay a ticket without consulting with our office. There may be a defense to help get your ticket dismissed or reduced.
